One year of permanent service as a Minority Business Specialist 1, Affirmative Action Administrator 1, or Compliance Specialist 1.
Open-Competitive and Non-Competitive Qualifications:
Seven years* of experience in the planning, development, implementation, and review of programs dealing with equal employment opportunity, human rights, affirmative action, minority, women-owned or service-disabled veteran-owned business program coordination, affirmative action compliance review, labor relations directly relating to affirmative action, or in the development and administration of programs directly related to minority community access to employment or business opportunities in the public and private sector. One year of this experience must have been in a supervisory capacity.
Substitution:
An Associate’s degree in business, marketing, economics, or public administration may substitute for two years of experience.
A Bachelor’s degree in business, marketing, economics, public administration, or public policy may substitute for four years of experience.
A Master’s degree in business, marketing, economics, public administration, or public policy may substitute for one year of experience.
Duties Description
Under the direction of the Contract Management Specialist 3, the Minority Business Specialist 2 (MBS2) will be responsible for all activities of the New York State Department of Environmental Conservation related to maintaining compliance with Article 15-A of Executive Law and the rules and regulations contained within 5 NYCRR Parts 140-44, as well as maintaining compliance with Article 17B of the Executive Law, such that MWBEs and SDVOBs have maximum practical opportunities to participate in New York State Department of Environmental Conservation procurements.
Duties of the position will include, but not be limited to, the following:
Work with senior staff and managers to develop the Agency’s annual MWBE/SDVOB goal plans.
Provide guidance and support to the Agency’s contract management staff on procurements and discretionary purchases to identify potential MWBE/SDVOB’s that may participate in solicitations.
Research MWBE/SDVOB availability and establish goals for Request for Proposals, Invitation for Bids, and other purchasing by the Agency.
Review MWBE/SDVOB utilization plans submitted in response to solicitations and work with potential contractors to assure understanding of the requirements under the program and opportunities to achieve the goals set within the procurement.
Work with Chamber staff to obtain MWBE waivers as required.
Research and recommend waiver approval for SDVOB goal participation.
Ensure that Agency contractors are in compliance with statutes, rules and regulations. Follow-up as necessary as provided in 5NYCRR.
Provide status reports on program compliance.
Ensure the Agency is compliant relative to quarterly reporting of MWBE participation on Agency contracts in the B2G Now contract system maintained by Empire State Development (ESD) and that information reported is accurate. Provide direction as necessary.
Ensure the Agency is in compliance relative to quarterly reporting of SDVOB participation on Commission contracts in required format.
Interact with the Agency’s Counsel’s Office for legal opinions and notifications to contractors as necessary.
Ensure timely reporting of Agency’s discretionary spending on a routine basis.
Oversee vendor equal employment opportunity reporting requirements.
Participate in MWBE/SDVOB meetings/calls held by ESD and Office of General Services (OGS).
Participate in training and outreach opportunities offered by ESD/OGS in relation to the MWBE/SDVOB programs and future initiatives.
Develop informational materials about how MWBE certified vendors and those interested in becoming MWBE certified can participate in state business;
Develop and direct an outreach and assistance program to increase the participation of minority owned businesses in public-funded programs and projects;
Keep apprised of changes in legislation that affect the MWBE/SDVOB programs and related policies.
Provide internal and external training as needed for MWBE/SDVOB programs.
Maintain and update Agency policies and procedures related to the MWBE/SDVOB programs.
